ELECTRONIC COMMUNICATIONS & E-SIGNATURE AGREEMENT

Please review this document carefully and either save it electronically or print a copy for your reference.
This E-Signature and Electronic Disclosures Agreement (“Disclosure”) applies to all communications related to Arival services available through the Arival’s (“Arival”) website https://ariv.al (the “Website”). “We,” “us,” and “our” refers to Arival. “User” and “you” refers to the business entity obtaining an Account.  This Disclosure supplements and is to be construed in accordance with the terms contained in the User Services Agreement (“Agreement”) you received when you obtain the Arival Checking Account (the “Account”), as well as all document referenced therein.
After you have read this Disclosure, you must agree to the terms and conditions and give your consent to receive account notices and disclosures as required by law including notices regarding changes to your account electronically by clicking the “I Agree” button below.
By clicking the “I Agree” button, which represents your electronic signature, you certify that you are an authorized signer for the account(s); that you understand you are legally bound; and that any transaction performed pursuant to this agreement shall be considered authorized by you.  If the account is a joint account, the electronic authorization by any joint account holder applies to all account holders and shall be considered authorized by all joint owners.

Scope of Communications to be Provided in Electronic Form

When you use a product or service to which this Disclosure applies, you agree that we may provide you with any communications in electronic format, unless and until you withdraw your consent as described below. Your consent to receive electronic communications includes, but is not limited to: 
  • All legal and regulatory disclosures and communications associated with the Account  and any related products or services;
  • The Agreement and any notices about changes in terms;
  • Privacy policies and notices;
  • Responses to claims filed in connection with the Account;
  • Notices regarding insufficient funds or negative balances; and
  • All other communications between us and User concerning the Account and any related transactions, products or services.
  • Method of Providing Communications to You in Electronic Form

    All communications that we provide to you in electronic form will be provided either (1) via email to the primary e-mail address you have provided us for your account or (2) by access to a website that we will designate in an email notice we send to you at the time the information is available.

    How to Withdraw Consent

    User may withdraw consent to receive communications in electronic form by contacting us at support@ariv.al. If User withdraws consent, the Account will be closed and a balance refund check may be issued in accordance with the terms of the Agreement. If User withdraws consent, the legal validity and enforceability of prior communications delivered in electronic form will not be affected.

    How to Update Your Records

    It is your responsibility to provide and maintain a current email address. You can update information (such as your email address) by logging into your online account at www.arival.com, or by e-mailing us at support@ariv.al. We are not responsible for any delay or failure in the receipt of the communications if we send the communications to the last e-mail address User provided to us.

    Hardware and Software Requirements

    In order to access, view, and retain electronic communications that we make available to you, you must have: 
  • Access to a personal computer, tablet or mobile device
  • An Internet browser that supports 128 bit encryption
  • An Internet browser, operating system and an Internet connection capable of receiving, accessing, displaying, and either printing or storing communications received from us in electronic form via a plain text-formatted email or by access to our website
  • The ability to download, and sufficient electronic storage capacity on your computer’s hard drive or other data storage unit to save a copy or access to a printer (if you wish to print a paper copy);
  • Access to software which permits you to receive and access Portable Document Format (PDF) Files, such as the most current Adobe® Acrobat® Reader® (available for download, free of charge, at http://get.adobe.com/reader/)
  • An email account and email software in order to participate in our electronic communications programs.
  • Requesting Paper Copies

    We will not send you a paper copy of any communication, unless you request it or we otherwise deem it appropriate to do so. You can obtain a paper copy of an electronic communication by printing it yourself or by requesting that we mail you a paper copy, provided that such request is made within a reasonable time after we first provided the electronic communication to you. To request a paper copy, please submit your request to support@ariv.al during normal business hours, except for national holidays. There are no fees associated with the reasonable request for the delivery of paper copies of any Communication provided electronically pursuant to this Disclosure.

    Communications in Writing

    All communications in either electronic or paper format from us to you will be considered “in writing.” You should print or download for your records a copy of this Disclosure and any other communication that is important to you.

    Consent

    By checking “I agree,” User adopts the checkmark as User’s electronic signature and User gives us affirmative consent to receive electronic communications as described herein. User further agrees that User’s computer satisfies the hardware and software requirements specified above and that a current e-mail address has been provided to us at which electronic Communications may be sent to User.

    Change in Terms and Conditions

    We reserve the right to change the terms and conditions of this agreement and will provide at least 30 days’ notice prior to the effective date to your primary e-mail address provided on file, if the change will result in increased fees or liability.  Continued access and usage of your account after you receive any notice of change will constitute your agreement to such change.  Certain notices, agreements, and disclosures may be required by law to be provided in hard copy even though you have agreed to receive such information electronically.

    Our Right to Terminate

    You acknowledge and understand that we may cancel this Agreement and corresponding services at any time and for any reason at the sole discretion of Arival.   If this Agreement is terminated, we will provide you with paper copies and disclosures by mail to the address provided on file.

    Additional Legal Considerations

    If the account(s) designated in this agreement is/are business account(s), the Account Holder agrees that the account(s) will be used solely for business purposes and shall not be used for personal, family, or household purposes.  The Account Holder acknowledges and agrees that the provisions of the Federal and Massachusetts Electronic Fund Transfer Act, Regulation E and other consumer protection laws and regulations do not apply.
    Arival Bank
